            This stallion breeding contract for the breeding season of  20____ is made and entered into on the _______ day of ________ 20______, by and between Gonsoir Quarter Horses and _________________________________________________, hereinafter designated as Mare Owner.  Gonsoir Quarter Horses agrees to breed the mare ___________________________ Registration # ___________________________ by

to the stallion Daddys Legacy, Registration # 3901191 and are subject to the following conditions:

 

Breeding Privilege and Charges:  Mare owner agrees to pay the stallion service fee of $500.  A nonrefundable $100 booking fee is to be paid for reserving the above named stallion upon execution of this agreement.  A copy of the mare’s registration papers must accompany this agreement.  The remaining $400 is payable at the time that the mare arrives at the farm, or prior to the shipment of semen.  The mare owner agrees to pay more mare care at a rate of $7.00 per day.  A semen collection and shipping fee of $285 will apply on each semen shipment.  Ultrasound fees and other vet service fees will be an additional expense to the mare owner.  The mare will not be released or semen shipped until all veterinary expenses, mare care, or any other charges incurred on behalf of the mare owner have been paid in full.  Shipped semen is also subject to availability due to on site breeding demands.

 

Waiver of Liability:  Gonsoir Quarter Horses agrees to diligently attempt to settle Mare Owner’s mare.  Mare Owner agrees to give Gonsoir Quarter Horses ample opportunity to settle the mare.  If, however, for any reason the mare does not settle, Mare Owner, will hold Gonsoir Quarter Horses blameless from any loss or damages.  The above applies to the normal breeding period, which is understood by both parties to be from February 15 to July 1 for the breeding year.  If the mare would fail to settle the Mare Owner has the option to substitute another mare approved the Gonsoir Quarter Horses during the current season or have a return for the following season.  Collection and shipment fees also apply to a replacement mare.  If said stallion should die, be sold by Gonsoir Quarter Horses, or become unfit for service prior to settling the mare, the service fee, including the booking fee, shall be refunded if it has been paid to Gonsoir Quarter Horses, thereby canceling the entire contract.  Gonsoir Quarter Horses will exercise reasonable care in caring for and supervising said mare and her offspring, but Gonsoir Quarter Horses will not be liable for any sickness, injury, disease, theft, or death of the mare and/or her offspring.  Insurance for the mare or her offspring is the sole responsibility of the Mare Owner.  The Mare Owner will have no liability to Gonsoir Quarter Horses for any injury, sickness, disease, or death of the stallion arising from the exercise of the breeding privileges granted herein.

 

Live Foal Guarantee:  Gonsoir Quarter Horses offers a live foal guarantee.  “Live Foal” is defined as a foal that stands and nurses without assistance after foaling.  Gonsoir Quarter Horses must be notified within seven days that the foal did not stand and nurse, or that no live foal will be produced from the Mare Owner’s mare.  Mare Owner then has the privilege to return during that breeding year or the following breeding year.

 

Certificates and Conditions:  If transported cooled semen is to be used the Mare Owner and Gonsoir Quarter agree to ship/handle semen appropriately.  For a shipment of semen the Mare Owner shall contact Gonsoir Quarter Horses at first detection of heat in the above named mare.  Gonsoir Quarter Horses/Groton Veterinary Clinic only collects and ships semen on Mondays, Wednesdays, and Fridays.  Gonsoir Quarter Horses requires a twenty-four hour notice for a semen shipment request.  A breeders certificate will be issued for the foal, conceived by this mating, when the stallion fee and all other expenses have been paid in full and when the mare has produced a live foal by this mating.  This contract is non-transferable and non-assignable.  No cash refunds will be given.  This contract is entered into in the State of South Dakota and will be interpreted and enforced under the laws of South Dakota.  If any clause in this agreement is against State Law, then that clause will be null and void.
